THE AUGGIE

Vacation Rental Terms and Conditions

St. Augustine, Florida | Historic District

Owner: Auggie STR LLC | Property Manager: Luxe Hospitality Group LLC | Effective October 2026

1. AGREEMENT AND PARTIES

These Terms and Conditions (the "Agreement") govern the short-term rental of The Auggie in St. Augustine, Florida (the "Property"). The Property is owned by Auggie STR LLC (the "Owner") and managed by Luxe Hospitality Group LLC (the "Manager"), which acts as property manager and agent for the Owner. "Guest" means the person making the reservation and every member of the Guest's party, each of whom is bound by this Agreement.

This Agreement becomes binding when the Guest submits payment or accepts these terms at booking, whichever occurs first. The Guest occupies the Property as a transient guest and licensee of the Owner, not as a tenant, and acquires no leasehold or other interest in the Property.

2. BOOKING CHANNEL

Direct bookings. Reservations made directly through theauggie.com or the Manager are subject to every section of this Agreement, including the payment schedule, cancellation and refund policy, and security deposit terms in Sections 4 through 7.

Bookings through an online travel agency (OTA): Cancellation and refund policy varies by OTA booking site. Refer to the policy referenced on your booking site. For reservations made through Airbnb, Vrbo, or any other third-party platform, that platform's payment schedule, cancellation and refund policy, and damage or security deposit terms control. All other sections of this Agreement, including occupancy limits, house rules, conduct, and fees for violations, apply to OTA reservations to the extent permitted by the booking platform's policies.

3. ELIGIBILITY AND OCCUPANCY

The Guest making the reservation must be at least twenty-five (25) years of age and must be present at the Property for the entire stay. By booking, the Guest confirms both.

Maximum occupancy is eight (8) guests. The Guest must submit a complete guest list, including children, before arrival instructions are released. Only persons on the guest list may stay overnight at the Property, and day visitors may not cause the number of persons on site to exceed maximum occupancy at any time. Exceeding maximum occupancy is a material breach of this Agreement and may result in removal from the Property without refund. Roll-away beds, inflatable mattresses, and sleeping bags are prohibited unless approved by the Manager in advance.

4. RATES, TAXES, AND FEES

The total reservation amount consists of the nightly rate, the cleaning fee, any processing fee displayed at booking, and all applicable Florida state and local sales taxes and St. Johns County tourist development tax. By providing payment information, the Guest authorizes the Manager to charge the payment method on file for the reservation amount in accordance with the payment schedule below, and for any additional charges incurred under this Agreement (see Schedule A).

5. PAYMENT SCHEDULE (DIRECT BOOKINGS)

  • • At booking: 30% of the total reservation amount is due.
  • • Balance: the remaining 70% is due five (5) days before the arrival date and will be charged automatically to the payment method on file.
  • • Late bookings: reservations made fewer than five (5) days before arrival are due in full at the time of booking.

If the balance cannot be collected by its due date, the Manager may cancel the reservation, and the cancellation and refund policy in Section 6 will apply to amounts already paid.

6. CANCELLATION AND REFUND POLICY (DIRECT BOOKINGS)

Refunds are calculated on prepayments actually received, based on when written notice of cancellation is received by the Manager:

Cancellation received

Refund of paid prepayments

30 or more days before arrival

100%

14 to 29 days before arrival

50%

Fewer than 14 days before arrival

0% (non-refundable)

Cancellations and date changes must be submitted in writing and confirmed by the Manager. A change of dates is treated as a cancellation of the original reservation and a new booking, subject to availability and current rates. If a reservation is canceled within the non-refundable period and the Manager re-rents the same dates, the Manager may, at its sole discretion, refund a portion of the amount paid; no refund is guaranteed.

No refunds, credits, or rebates are given for late arrival, early departure, no-shows, members of the party who do not attend, or failure to follow the arrival instructions. No refunds are given for weather, including hurricanes and tropical storms, evacuation orders, acts of God, government action, utility or internet outages, or other circumstances outside the Manager's control. The Manager strongly recommends that Guests purchase travel insurance. If the Manager or Owner cancels a reservation for reasons other than the Guest's breach, the Guest will receive a full refund of all amounts paid, which is the Guest's sole remedy.

7. SECURITY DEPOSIT OR DAMAGE WAIVER (DIRECT BOOKINGS)

A pre-authorization of $250.00 will be placed on the Guest's payment method one (1) day before arrival. This is a hold, not a charge, and will be voided five (5) days after departure if no charges are owed. The Guest authorizes the Manager to capture all or part of the hold for damage beyond normal wear and tear, missing items, additional cleaning, or any fee under Schedule A. Amounts owed in excess of $250.00 will be charged to the payment method on file. The Manager will notify the Guest and provide an itemized description, with supporting photos where applicable, before any charge is made.

Damage waiver option. In lieu of the security deposit pre-authorization, the Guest may elect to purchase a one-time damage waiver for the length of the stay for a non-refundable fee of $75.00 per stay, under the terms of The Auggie Guest Damage Waiver. The waiver does not cover damage caused intentionally, recklessly, or through gross negligence, violations of this Agreement, or the charges listed in Schedule A, all of which remain the Guest's responsibility and will be charged to the payment method on file.

Pre-existing damage. To protect the deposit, the Guest should inspect the Property on arrival and report any existing damage to the Manager within four (4) hours of check-in.

For OTA reservations, damage and incidental charges will be pursued through the booking platform's resolution process.

8. CHECK-IN AND CHECK-OUT

Check-in is at 4:00 PM and check-out is by 11:00 AM. The Property will not be available before check-in time. Early check-in or late check-out may be requested and is subject to availability and the Manager's written approval. Unapproved early arrival or late departure authorizes the Manager to charge up to one (1) night's rental rate.

Before departing, Guests are asked to run the dishwasher, place used towels on the bathroom floors, turn off the lights, and lock all windows and doors, and to follow any additional check-out procedures in the house guide.

9. ARRIVAL AND ACCESS

Arrival instructions. Arrival instructions, including the Property address and the Guest's door access code, are sent once the reservation is paid in full and the guest list has been submitted.

Keyless entry. The Property uses a keypad lock. The access code may not be shared with anyone outside the registered party. Guests must lock all doors and windows whenever they leave the Property and at departure. If the access code does not work, contact the Manager for an alternate access solution. Damage to the lock, or a service call caused by misuse, will be charged at actual cost.

10. NEIGHBORHOOD, CITY RULES, AND PARKING

The Property is located in a residential neighborhood in St. Augustine's historic district. Guests must comply with all City of St. Augustine and St. Johns County ordinances, including those governing noise, parking, and trash. Any fine or charge assessed against the Owner as a result of the conduct of the Guest's party will be charged to the Guest.

Parking. A maximum of four (4) vehicles is allowed: three (3) in the driveway and one (1) in the rear alley space. Street parking is at the Guest's own risk; the City enforces parking restrictions that vary by location and time of year, and any parking ticket, fine, or towing charge is the Guest's responsibility.

11. HOUSE RULES AND CONDUCT

  • • No parties or events. The Property is a private residence and may not be used for parties, reunions, weddings, or other gatherings.
  • • No overnight visitors. Only persons on the registered guest list may stay overnight.
  • • Quiet hours are 10:00 PM to 8:00 AM. Guests must not disturb neighbors at any time.
  • • No smoking or vaping of any substance, of any kind, anywhere inside the Property. Smoking indoors, or leaving cigarette butts on the grounds, will result in an odor-abatement and cleanup charge of not less than $250.
  • • No pets. Pets of any kind are not permitted at the Property. A pet found on the Property is a breach of this Agreement and will result in a charge of not less than $250 plus the cost of any damage and additional cleaning. Service animals are accommodated as required by applicable law and booking platform policy.
  • • Alcohol and drugs. Consumption of alcohol by anyone under twenty-one (21) and use of illegal drugs are prohibited and are grounds for immediate removal without refund.
  • • Firearms, fireworks, and projectiles. Discharging firearms, BB or pellet guns, paintball guns, or fireworks on or near the Property is prohibited.
  • • Furnishings. Furniture is arranged as the Owner intends. Please return any moved furniture to its original position before check-out.

12. TRASH AND RECYCLING

All trash must be bagged and placed in the garbage cans located behind the Property in the alley. Trash and recycling collection days are listed in the house guide. Loose or overflowing trash left outside the cans may result in a cleanup charge.

13. CLEANING

The Property is cleaned and inspected before each arrival. Guests must leave the Property in a reasonably clean, undamaged condition and follow the check-out procedures. If the Property requires cleaning beyond the normal turnover (for example, carpet or upholstery cleaning, or food left in cookware), an additional cleaning charge may apply. The Guest will be notified before that charge is made.

14. AMENITIES

Smart TVs. Televisions are smart TVs; Guests must use their own streaming accounts. Guests sign in at their own risk and must sign out before departure. Neither the Owner nor the Manager is responsible for Guest account activity left signed in after check-out.

Grill. Where a propane grill is provided, it is fueled by propane only. Do not add charcoal or any charcoal product.

Fireplace. The indoor fireplace is decorative and non-functional and may not be used for any purpose.

Fire pit. The fire pit may be used year-round. Never leave a burning or smoldering fire unattended. Firewood is not provided; Guests must bring their own. Burn only firewood: no trash, lighter fluid, or other materials. Guests must comply with any burn ban in effect. Violations that result in a fine by the authorities will be the responsibility of the Guest.

15. MAINTENANCE AND UTILITIES

Guests must notify the Manager promptly of any equipment breakdown, damage, or defect. The Manager will make every reasonable effort to resolve problems in a timely manner but cannot guarantee uninterrupted heat, air conditioning, electricity, water, internet, appliances, electronics, or other systems, and no refunds or rebates will be given for their failure. If a repair is needed because of a Guest's misuse, neglect, or oversight, the cost of the service call and repair will be charged to the Guest.

Construction, road repair, and routine maintenance (such as lawn care) may occur in the area or at the Property during a stay. Work at the Property will not begin before 9:00 AM, and every effort will be made to minimize disruption. No refunds will be given for these inconveniences.

16. RIGHT OF ENTRY

The Manager and its contractors may enter the Property during a stay with reasonable advance notice to make repairs or perform maintenance, and without notice in an emergency or when the Manager has reason to believe this Agreement is being violated, including to verify occupancy or investigate a disturbance or damage.

17. ITEMS LEFT BEHIND

Neither the Owner nor the Manager is responsible for items left at the Property. If items are found, the Manager will attempt to contact the Guest. Return shipping is charged at a $25 handling fee plus actual shipping cost. Unclaimed items will be discarded or donated after seven (7) days.

18. INTERNET USE

Wi-Fi is provided at no charge as a courtesy, "as is" and "as available," without warranty of any kind; network credentials are provided at the Property. Neither the Owner nor the Manager is responsible for slow or interrupted service, and the Guest's sole remedy for dissatisfaction is to stop using it. The service may not be used for any unlawful purpose. The Guest is responsible for all use of the service by members of the party, including minors, and agrees to indemnify the Owner and Manager against any claim arising from that use. Access ends at check-out.

19. VIOLATIONS AND REMOVAL

Any material breach of this Agreement, including exceeding maximum occupancy, hosting a party, damaging the Property, creating a nuisance or breach of the peace, endangering any person, or violating any law or ordinance, entitles the Manager to terminate the Guest's occupancy and require the Guest's party to leave immediately, with forfeiture of all amounts paid. The Guest acknowledges that the Property is a transient public lodging establishment and that the Manager may remove guests as permitted by Section 509.141, Florida Statutes. A Guest who fails to leave when required, or who remains after the scheduled check-out, is a trespasser, and the Manager may request assistance from law enforcement. Reservations obtained by fraud or misrepresentation, including about the purpose of the stay or the number of guests, will be canceled with forfeiture of all amounts paid, and the party will not be permitted to check in.

20. ASSUMPTION OF RISK, INDEMNIFICATION, AND LIMITATION OF LIABILITY

The Guest assumes all risk of injury, illness, loss, or damage arising from the use of the Property, its furnishings and amenities, and any recreational activity, and should inspect and understand the proper use of any item before using it. The Guest is responsible for all damage to the Property, and for any injury or loss to any person or property, caused by the Guest's party. To the fullest extent permitted by law, the Guest agrees to indemnify, defend, and hold harmless the Owner, the Manager, and their respective members, managers, employees, and agents from all claims, including claims by third parties, and all related costs and reasonable attorneys' fees, arising out of or related to the Guest's party's use of the Property, except to the extent caused by the gross negligence or willful misconduct of the indemnified party. Neither the Owner nor the Manager is responsible for loss of or damage to personal property, including money and jewelry. In no event shall the liability of the Owner or Manager exceed the total amount paid for the reservation.

21. AGENCY DISCLOSURE AND NON-DISCRIMINATION

Luxe Hospitality Group LLC acts as property manager and agent for Auggie STR LLC and acts at all times in the Owner's interest. The Manager reserves the right to refuse service to anyone for any lawful reason. The Property is rented without regard to race, color, religion, sex, national origin, disability, or familial status. Information in the Property's listings is believed to be accurate but is not guaranteed.

22. RADON GAS DISCLOSURE

As required by Section 404.056(5), Florida Statutes: RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.

23. GOVERNING LAW AND VENUE

This Agreement is governed by the laws of the State of Florida and is deemed executed in St. Johns County, Florida. Any action relating to this Agreement shall be brought only in the state courts located in St. Johns County, Florida, and the Guest consents to that jurisdiction and to service of process outside the State of Florida.

24. GENERAL

This Agreement, together with the reservation confirmation, The Auggie Guest Damage Waiver (if purchased), and the house rules posted at the Property, is the entire agreement between the parties regarding the stay and supersedes all prior terms, including any terms issued under a prior owner or management company. If any provision is found unenforceable, the remaining provisions remain in full effect. The Manager's failure to enforce any provision is not a waiver of it. By completing a reservation, the Guest confirms that the Guest has read, understands, and agrees to this Agreement on behalf of every member of the party.
